Key Legal Obligations for E-Commerce Websites in Türkiye
Pre-contractual information, distance sales agreements, right of withdrawal, ETBİS registration and cookie management: what an e-commerce site should check before going live.
Businesses selling online are subject to numerous rules, in particular Consumer Protection Law No. 6502, the Distance Contracts Regulation and Law No. 6563 on the Regulation of Electronic Commerce.
Pre-Contractual Information and Distance Sales Agreement
Before the contract is concluded, the consumer must be clearly informed about the seller’s identity, the main characteristics of the product, the total price, payment and delivery terms and the right of withdrawal. The seller bears the burden of proving that this information was provided.
Right of Withdrawal
As a rule, the consumer may withdraw from the contract within fourteen days of delivery without giving any reason and without paying a penalty. Exceptions are listed exhaustively in the regulation.
ETBİS and Commercial Messages
E-commerce service providers must register with the Electronic Commerce Information System (ETBİS). Commercial electronic messages may only be sent with the recipient’s prior consent and in line with the Message Management System (İYS) rules.
Personal Data and Cookies
A privacy notice must be provided during sign-up and checkout, and explicit consent must be obtained for non-essential cookies. Users should also be able to change their cookie preferences easily.
